Khalid was arrested by the Delhi Police in September 2020
Khalid had sought bail on grounds that he neither had any criminal role in the Delhi violence nor any "conspiratorial connect" with any other accused in the case.
A bench of Justices Aniruddha Bose and Bela M Trivedi said the matter needs to heard on a non-miscellaneous day.
Khalid's petition challenging the October 18 last year order of the Delhi High Court, which had rejected his bail plea in the matter, came up for hearing before a bench of Justices A S Bopanna and Prashant Kumar Mishra.
Now the court will hear the case again on July 24.
Awaiting his trial, Khalid has been behind bars since September 2020 for his alleged involvement in the larger conspiracy over the communal violence in February 2020.
Khalid was booked under the UAPA and provisions of the IPC for allegedly being a mastermind of the February 2020 riots, which had left 53 people dead and over 700 injured.
The court also said the actions of the accused prima facie qualified as a terrorist act under the anti-terror law UAPA.
Khalid was questioned by the Delhi Police Crime Branch for a couple of hours on September 2 in connection with the riots.
In a video that went viral on August 16, Shahpur and Dalal said that they will surrender to police at a gurdwara near the house of freedom fighter Kartar Singh Sarabha the next day.
