A court had on November 3 granted anticipatory bail to Perumbavoor MLA accused of rape and attempt to murder. This order was challenged in the High Court.
Calling the case an unusual story, the court said. 'Even in a case where 100 times you consent for sexual relations, if you do not give consent for the 101st time, it amounts to rape. No doubt.'
The court was considering a plea by the complainant and the government requesting it to cancel the anticipatory bail granted to the legislator.
The Additional Sessions court has also stated that the Perumbavoor MLA should present himself before the Investigating Officer between November 10 and 11.
The court directed the MLA to appear before the investigating officer everyday at 9 AM and to cooperate with the probe.
The government argued in the court that Eldos is not cooperating and this is hindering the progress of the investigation.
On October 25, the complainant who charged Eldose with assault, rape, murder-bid and defamation charges, filed two more cases against him - for assaulting her again and disrespecting womanhood.
The legislator from Perumbavoor who came out of hiding on Saturday has been suspended from KPCC and DCC for 6 months.
