Will Dileep be third-time lucky? All eyes on Kerala HC The courts earlier rejected four bail pleas by Dileep - twice each in the trial court and the high court.

Kochi: The counsel of actor Dileep, who was arrested for allegedly plotting the February 17 actress attack, has contended that the remand report by the probe officials does not clearly state even the charges slapped on the embattled star.

The counsel made the arguments as the Kerala High Court was considering the fifth bail plea filed by Dileep Tuesday.

"We still do not know what are the charges slapped on Dileep. It is the accused's right to know the charges against him. The police are not providing any details," Dileep's counsel said.

This is the third time Dileep has approached the Kerala HC seeking bail. Earlier, he had moved the First Class Judicial Magistrate Court in Angamaly twice, though in vain.  

"Each time the court has denied bail to Dileep citing that the key evidence, a mobile phone used to shoot the assault on the actress, was yet to be recovered. However, even after seven months of probe, the police have not been able to find it," he argued.

The prosecution's hearing is on Wednesday. The Angamaly court had earlier extended the judicial remand of Dileep till September 28.

The HC had last week postponed the bail plea hearing to September 26 and asked the state government to give its opinion in the case. The court had then asked whether there was any major change in circumstances. The court said if the answer was in the negative, it would not take up the matter urgently. The court had also said it would consider Dileep's petitions only after the considering the anticipatory bail pleas of actress Kavya Madhavan, Dileep's wife, and director Nadhirshah.

HC dismisses Kavya's plea

The Kerala High Court Monday dismissed the anticipatory bail plea of Kavya after the police gave an assurance that she will not be arrested in the abduction and sexual assault case. The court also adjourned the anticipatory bail application of Nadhirshah, a close friend of Dileep, to October 4 for further consideration.

Dileep has been lodged in the Aluva sub jail after being arrested in the case on July 10. In his bail plea, Dileep had submitted that he had completed 60 days in judicial custody and therefore, he was entitled to statutory bail.

The prosecution had opposed his bail plea on the ground that the investigation into the case was yet to be completed.

The young actress was abducted and assaulted in a moving car in Kochi on February 17. She was taken around in her vehicle forcefully for about two hours before being dumped near actor-director Lal's home, from where the police was informed.

The key accused - Pulsar Suni and his accomplices involved in the abduction - were arrested a week later. After detailed questioning, the police unearthed a conspiracy angle that led to the actor's arrest.
