Major changes to Canada’s open work permits for international students and workers from Jan 21

Canada is introducing significant changes to its Open Work Permit (OWP) policies for the family members of international students, foreign workers. The revised norms will take effect on January 21, with detailed guidelines to be announced the same day.
The Open Work Permit system has allowed family members of international students and workers to join the Canadian workforce. However, starting January 21, only specific categories of international students and workers will qualify for it. While the move narrows eligibility, it is seen as advantageous for many Indians already residing in Canada.
Key changes
- Eligibility for spouses of international students: Only the spouses of students pursuing Master’s, PhD, or select professional courses lasting more than 16 months will qualify for the OWP.
- Eligibility for spouses of foreign workers: OWPs will be issued to the spouses of workers in occupations classified under TEER 0 or TEER 1. Spouses of workers in certain TEER 2 or TEER 3 professions, including science, construction, health, education, sports, and military services, will also qualify.
- Work permit duration for spouse applications: The primary foreign worker’s permit must have at least 16 months of validity when their spouse applies for an OWP.
- Exclusion of children:Under the revised norms, children of foreign workers will no longer be eligible to apply for an OWP.
- Retroactive permits: Permits already issued will remain valid till the end of their tenure.
These changes, however, do not apply to individuals covered under Free Trade Agreements or those in the Permanent residency scheme.
