A week after a bar dancer from Mumbai accused Kerala CPM secretary Kodiyeri Balakrishnan's elder son Binoy of decade-long sexual abuse, the woman has come up with fresh evidence against him.

Adding more credence to her allegations against Binoy, the woman, who is from Bihar but stays in Mumbai now, has submitted the birth certificate of her son in which it is clearly stated that Binoy Kodiyeri is the boy's father.

In her complaint filed at Oshiwara police station in Mumbai, she had stated that Binoy had met her in Dubai and she used to visit him at his flat in the Gulf country and he is her son's father. The birth was registered in Mumbai Municipal Corporation in 2010. A copy of the birth certificate has been obtained by Manorama.

Meanwhile, a letter by the complainant alleging that she was threatened with her son's kidnap has also surfaced. The letter from December addressed to Binoy also seeks compensation from him. However, the complainant has opined that the threat was driven by fear. She did not think Binoy could commit such an act as a father.

The details in the lady's passport may also prove crucial in the case. Her renewed passport from 2015 reveals Binoy Vinodini Balakrishnan as the name of the spouse. The woman had altered her name to accommodate Binoy's name prior to the passport renewal.

A newspaper advertisement has also been published to this effect. A gazette notification has to be published to legally complete the name change of any individual.

The Mumbai police began their investigation after examining the documents. It is possible to confiscate the passport and begin legal proceedings against a passport holder if wrong details are added in the document. However, no case to this effect has been filed by Binoy.

Bail application decision today

The cops are yet to track down Binoy, who is on the run. The Dindoshi Court in Mumbai is set to make a decision on his anticipatory bail plea on Monday.

During the hearing of the bail plea on Friday, Binoy Kodiyeri's counsel Ashok Gupta argued that it was a cooked-up case and an attempt to blackmail his client, while the prosecution, opposing the bail, said all the required evidences are there and have been produced before the court.

The prosecution has also argued that Binoy must be subjected to DNA paternity testing to determine whether he is the father of the complainant's child and therefore, not be granted bail.

After hearing the arguments, the court said it would deliver its ruling on Monday.

Bar dancer's allegations

In the FIR filed at the Oshiwara police station in Andheri area, the 33-year-old Mumbai-based woman alleged that Binoy sexually exploited her for several years on the promise of marriage and claimed they also have a child.

She registered the complaint on June 13 after she came to know that he was already married.

According to her complaint, she entered into a relationship with Binoy while working at a dance bar in Dubai in 2008 and now has an eight-year-old child with him. She alleged that till 2015, Binoy even used to send her money every month.

The victim has also handed over some crucial documents, including pictures, to the police.

A Mumbai police team came to Kerala last week to arrest Binoy. But Binoy, who was in Kannur district, had given cops the slip and his mobile phones were switched off.

Meanwhile, his father and CPM state secretary Kodiyeri Balakrishnan on Saturday sought to distance the party and himself from the case.

Looking visibly uncomfortable as he faced a barrage of questions from the media, Kodiyeri said his son Binoy was an adult and responsible for his actions, adding that he need not expect any protection from him or the party.

The CPM's stand on the issue had earlier been made clear by its General Secretary Sitaram Yechury, who had stated that the party will not interfere in the matter as it was an issue related to an individual and not to the party, he said.

This is the second time Binoy courted controversy. A few months ago, he was allegedly involved in a financial fraud case in one of the Gulf countries.

The Mumbai police had on Thursday served a notice to Binoy, asking him to appear within 72 hours before the Investigating Officers probing the case.

Two Mumbai cops, along with two local police personnel, went to Binoy's ancestral home at Thiruvangad in Thalassery in Kannur district and handed over the notice to the relatives.

Binoy has been booked under Indian Penal Code sections 420 (cheating) and 376 (rape) in the case filed in Oshiwara police station.
