Kavya gets a breather, Nadhirshah's bail plea hearing postponed

The popular faces from the Malayalam film industry moved the court for anticipatory bail as they feared arrest in the sensational February 17 actress attack case.

Kochi: The Kerala High Court on Monday dismissed the anticipatory bail plea of actor Kavya Madhavan after the police gave an assurance that she will not be arrested in an abduction and sexual assault case in which her actor-husband Dileep was arrested in July this year.

Justice P Ubai also adjourned the anticipatory bail application of Malayalam actor Nadhirshah, a close friend of Dileep, to October 4 for further consideration.

The court recorded the statement of the police that they have no intention to arrest Kayva.

Dileep was arrested for allegedly plotting the abduction and sexual assault of a Malayalam actress.

The Malayalam actor's wife had filed the anticipatory bail plea in the high court on September 16.

In her petition, Kavya had alleged that the officers in the probe team "made open threats of arraigning" her as an accused to "cover up lacunas in the unfounded allegations against her husband and intimidate" all persons associated with him.

Nadhirshah was questioned by the police on September 17 in connection with the actress abduction case.

Last week, a magistrate court in Angamaly had rejected the bail plea of Dileep for a second time.

The high court had also rejected his bail plea twice.

Dileep has been lodged in the Aluva sub-jail after being arrested in the case on July 10.

In his bail plea, Dileep had submitted that he had completed 60 days in judicial custody and therefore, he was entitled to statutory bail.

The prosecution had opposed his bail plea on the ground that the investigation into the case was still not completed.

The Angamaly court had extended the judicial remand of Dileep till September 28.

Six persons, including key accused 'Pulsar' Suni, were arrested in connection with the incident.

The high court had dismissed Dileep's second bail petition that came up on August 29 after considering the evidence against the actor. The prosecution had submitted the evidence to the court in a sealed cover.

The police have claimed that a conspiracy to abduct and assault the actress in a moving car and film the act was hatched by Dileep.

The actress, who has worked in Tamil and Telugu films, was abducted and allegedly molested inside her car for two hours by the accused who had forced their way into the vehicle on February 17 night. They later made their escape.
